1. Overview of the Service

Zeb enables real estate professionals to engage and qualify leads through AI-generated SMS conversations. Our system analyzes responses, helps identify serious buyers, and provides tools to follow up efficiently.

2. Eligibility

To use Zeb, you must:

• Be at least 18 years old
• Have the legal capacity to enter into a contract
• Be authorized to act on behalf of a real estate business (if applicable)

You represent and warrant that all information you provide is accurate and complete.

3. Account and Access

• You must maintain the confidentiality of your account credentials.
• You are responsible for all activity occurring under your account.
• You may not share access with others unless your subscription plan permits team use.
• We reserve the right to suspend or terminate access at our discretion for violations of these Terms.

4. Use of the Service

You agree not to:

• Use Zeb for illegal, deceptive, or harmful purposes
• Send spam or unsolicited marketing via SMS
• Impersonate others or misrepresent your affiliation
• Attempt to access systems or data you are not authorized to access
• Reverse-engineer or interfere with our software

You are solely responsible for the content you send through Zeb.

5. AI Responses and Limitations

Zeb uses AI models (including third-party LLMs) to generate responses and classify lead behavior. These responses are based on patterns and data but are not guaranteed to be accurate, timely, or complete. Zeb does not provide legal, financial, or real estate advice.

Always verify lead information and exercise your own judgment before making decisions based on AI outputs.

6. Messaging and Compliance

By using Zeb, you acknowledge that:

• You are responsible for complying with applicable laws (such as the U.S. TCPA and CAN-SPAM).
• You must obtain proper consent from leads before sending SMS messages.
• Use of Zeb to harass or mislead recipients is strictly prohibited.
• We may monitor SMS usage and suspend accounts found in violation.

7. Subscription, Billing & Cancellation

• Zeb operates on a subscription basis with monthly or annual plans.
• Fees are billed in advance and are non-refundable unless required by law.
• Plan limits (e.g. message count, users) are based on your subscription tier.
• You may cancel at any time; service continues through the end of the billing cycle.
• We may update pricing or features with prior notice.

8. Refund Policy

All Zeb subscriptions are billed in advance and are non-refundable, including partial months or unused time. You may cancel your subscription at any time, and your access will remain active until the end of your current billing period.

In cases where there is a technical issue on our part that prevents you from using the service, please contact us within 7 days at support@textzeb.com. We'll investigate and may offer a pro-rated refund at our sole discretion.

We do not offer refunds for user error, dissatisfaction due to unmet expectations, or failure to cancel before renewal.

9. Intellectual Property

All content, software, and branding on Zeb are owned by us or our licensors. You may not:

• Copy, distribute, or modify Zeb's code or branding
• Use our name or logo without written permission
• Claim ownership of any part of the Zeb platform

10. Service Availability and Modifications

We strive for reliable performance, but do not guarantee uninterrupted access. We may modify, update, or discontinue the service at any time. We are not liable for interruptions caused by events beyond our control.

11. Termination

We may terminate or suspend your account if you:

• Violate these Terms
• Have failed or disputed payments
• Engage in abusive, unlawful, or harmful behavior
• Are required to be suspended under applicable law

After termination, your access and stored data may be lost. Please export any important information before closing your account.

12. Disclaimer of Warranties

Zeb is provided "as is" and "as available." We disclaim all warranties, including:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or reliability of AI-generated content

You use Zeb at your own risk.

13. Limitation of Liability

To the fullest extent allowed by law, we are not liable for indirect, incidental, or consequential damages, including lost profits, data, or business opportunities. Our total liability is limited to the amount paid to us in the 3 months prior to the claim.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of the Philippines. Any disputes shall be resolved through binding arbitration in Cebu City, Philippines, unless otherwise required by applicable law.

15. Changes to These Terms

We may revise these Terms at any time. Updates will be posted on our website or sent via email. Continued use of Zeb after changes means you accept the new Terms.
